Nana Knight Secures Rehab Release for San Jose Officer Charged with Gunfire While Intoxicated
San Jose Police Officer Timothy Lee Faye, a 22-year veteran of the department, was released from jail and ordered to attend a Southern California rehabilitation program that treats first responders, despite objections from the prosecution. Faye faces two felony charges of grossly negligent firearm discharge — both allegedly committed while drunk inside an ex-girlfriend’s home, including one incident where he shot a closet and another where a bullet was later found in drywall.
Faye was arrested after an earlier misdemeanor child abuse accusation in Monterey, though no charges had been filed in that case as of the court hearing. During questioning, Faye cited alcohol abuse and PTSD from his involvement in fatal police shootings in 2015 and 2018.
Attorney Nana Knight, representing Faye, successfully argued for his release into treatment, noting his years of service and mental health toll from police work. Knight emphasized that Faye deserves due process and urged the public to avoid rushing to judgment. “Our society expects police officers to absorb some of the most traumatic and gut-wrenching events imaginable,” she said, describing his service as courageous and calling for compassion and fairness. Faye will remain under supervision, required to report to San Jose PD’s internal affairs and wear a GPS monitor if he completes rehab before trial. Some SJPD colleagues alleged leadership ignored prior warnings about Faye’s alcohol issues. The case continues, with Faye due back in court on August 20.
